Nature of Complaint
Tip or Complaint: On November 13, 2024, the berm along Mountaintown Creek on my property at 3815 Gallery Court (550 Falcon Trail) was destroyed by heavy equipment, with all riparian vegetation removed and soil pushed into the creek. A subsequent attempt was made to “repair” the berm, but the work failed to follow Best Management Practices under Georgia’s Erosion & Sedimentation Act. As a result, I am now incurring approximately $5,000 in costs to stabilize and restore the berm properly to BMP standards. LIA approved repair by Teague but NOT to BMPs, it failed, I had LIA come out and do another repair and this time restoration LIA had no issue but failed to mention it still was not to BMPs, third attempt about to be done with total costing me not the contractor responsible for damages. GA EPD backs up LIA and/or defers to them but they are not coming close to BMPs of GESA.
